(Orlando, FL) In her ongoing monitoring of the Federal Trade Commission’s (FTC’s) Rule banning non-compete agreements, scheduled to become effective September 4, 2024, attorney Nichole Mooney publishes “Pennsylvania Court Upholds Non-Compete Ban.” In the article, Nicky reviews Judge Kelley Brisbon Hodge’s July 23 decision which affirms the Federal Trade Commission possesses clear legal authority to establish rules aimed at preventing unfair competitive practices.
The author writes, “Judge Kelley Brisbon Hodge affirmed in ATS Tree Services, LLC v. Federal Trade Commission that the FTC possesses clear legal authority to establish both procedural and substantive rules aimed at preventing unfair competitive practices.” This is the second federal judge to preliminarily rule in this matter and contradicts a decision made by a District Court on July 3.
