DOL Overtime Rule Overturned by Federal Judge, Penned by Attorney Nichole Mooney

Published: December 4, 2024

(Orlando, FL) Following a Texas federal court ruling, for now minimum salary levels have reverted to pre-2024 amounts. Attorney Nichole Mooney explains the ruling further in her article “Employers Breathe Sigh of Relief: DOP Overtime Rule Struck Down.”

If it had been upheld, the U.S. Department of Labor final rule would have extended overtime pay eligibility to millions of previously exempt workers, raising the salary threshold from $684/week or $35,568 annually to $844/week or $43,888 annually, as of July 1, 2024. The threshold would have raised again to $1,128/week or $58,656 annually as of January 1, 2025.

The author writes, “The DOL is expected to appeal the decision, and the court of appeals may issue a stay to keep the rule in effect while it considers the case. It is important for employers to stay informed of any updates that may reinstate the higher thresholds.
