On Wednesday, May 27th, the U.S. Environmental Protection Agency (“EPA”) released its new Clean Water Rule, which has also been referred to as the “Waters of the United States” rule, in an attempt to clarify the limits of its jurisdiction under the federal Clean Water Act. Attacked by farm interests and heralded by environmental groups, the almost 300-page federal rule was revised from an original draft after over 400 meetings and more than 1 million public comments. The rule will become effective 60 days after publication in the Federal Register. Attached are two fact sheets prepared by EPA to attempt to explain what the new rule does, and what it does not do. Dean Mead’s Agribusiness Industry Team will be reviewing the new rule and monitoring its impacts as it is implemented.
