Our Employee Benefits Practice Group knows every facet of employee benefits law, including the design, structure, implementation, administration, operation of programs, determination of best benefits structure, drafting and adoption of specific plans, preparation of necessary employee communications, satisfaction of applicable governmental reporting requirements, executive compensation, health and welfare benefit plans, and termination of benefits plans. We represent a wide array of employers, OIC, state and local middle-market employers, and an extensive number of professional associations in the medical, legal, accounting, architectural, and engineering fields.
Our attorneys help clients with the design, installation, and ongoing operation of tax-qualified and nonqualified deferred compensation plans, such as safe harbor 401(k) plans, cross tested-profit sharing plans, defined benefit pension plans, employee stock ownership plans (ESOPs), supplemental executive retirement plans, and qualified and nonqualified stock option plans. Additionally, we amend these plans as needed to comply with federal and state law changes.
We have successfully assisted clients in rectifying operational and fiduciary issues concerning retirement plans by amending and restating these plans to maintain their tax-qualified status. We also have planned and implemented the creation of ESOPs, providing representation of selling shareholders, companies, and ESOP fiduciaries with respect to the sale and purchase of employer securities.
